Terms of service

Use it for your own software, do not attack it or resell it, and it stays yours to walk away from at any time. We will keep it running as well as we reasonably can, and we are honest below about what happens when we don't.
1. Who this is between
This agreement is between Sergio Sola Dominguez, an individual trading under no company, of Vilanova i la Geltrú, Barcelona, Spain (“we”, “us” — one person, throughout), and the person or organisation using Sixty (“you”). It applies from the moment you use the service, whether or not you signed anything. If you are agreeing on behalf of a company, you are confirming you are allowed to.
If a company is formed later to run Sixty, this agreement moves to it and we will tell you before that happens — a change of who you are contracting with is not something to discover in a diff.
2. What the service is
Sixty measures the performance and behaviour of software you operate, compares it across your deploys, and reports what changed. It is a diagnostic tool. It is not a monitoring or alerting system you should rely on for safety, medical, financial or legal purposes, and it does not guarantee that a problem will be detected — only that we will tell you about the ones we find.
3. Your account
Keep your credentials and API keys to yourself. Anything done with your keys is treated as done by you, so revoke one the moment you think it has leaked — you can do that yourself from settings, immediately, without asking us. Tell us if you believe your account has been accessed by someone else.
4. What you must not do
- Use the service to monitor software you have no right to monitor, or to collect information about people who have not been told.
- Send us personal data. The libraries are built so that end-user data does not reach us, and you must not defeat that — do not put names, email addresses, identifiers or anything else personal into route names, operation names, service names or release identifiers. If you do, you are the controller of it and you are responsible for it.
- Attack the service, probe it without permission beyond good-faith security research reported to us, or attempt to reach another customer's data.
- Resell the service, or use it to build a competing one.
- Send volumes that materially degrade the service for others. We would rather talk about your load than throttle it, but we may throttle it.
5. Who owns what
Your data is yours. The software, the detection logic and everything on this site is ours. You grant us the licence needed to process your data in order to provide the service — to store it, analyse it, compare it across releases, and send findings for explanation as described in the privacy policy — and no more than that. We do not use your data to train models, and we do not sell it.
Aggregate statistics about the service itself — how many findings a detector produces, how it performs — remain ours to use, provided they identify neither you nor anything about your software.
6. Availability
We aim to keep the service available and will give notice of planned maintenance where we can. Unless we have separately signed a service level agreement with you, we do not promise a particular uptime. Telemetry that arrives while we are down may be lost, and given the retention windows in the privacy policy, lost usually means gone.
7. Changes to the service
Features will change. If we remove one you depend on, or make a change that breaks an integration, we will give reasonable notice by email first.
8. Fees
Where the service is paid, the price, billing period and any usage limits are those agreed with you in writing or shown at sign-up. Fees are payable in advance and are not refundable for a period already begun, except where the law says otherwise. We will give at least 30 days' notice before a price change, and you may cancel rather than accept it.
9. Ending it
You can stop at any time: remove the integration and close your account. We may suspend or end your access if you breach these terms, if we are required to, or if your use is causing a genuine problem for the service — with notice wherever the circumstances allow it. When an account closes we delete its data within 30 days, except where we are required to keep something.
10. No warranty
The service is provided as it is. Beyond what the law requires of us, we do not warrant that it will be uninterrupted, that it will find every problem in your software, or that everything it does find will be correct. Its output is evidence for you to judge, not a verdict — including the parts written by a language model, which can be confidently wrong.
11. Liability
Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited — and if you are a consumer, your statutory rights are unaffected by anything on this page.
Otherwise, and to the extent the law allows: neither of us is liable to the other for lost profits, lost revenue, lost data or indirect loss, and our total liability arising out of this agreement is limited to the greater of the fees you paid us in the twelve months before the claim, or €100.
12. Data protection
Where we process personal data on your behalf, we do so as your processor on your documented instructions, under the terms of the privacy policy and with the sub-processors listed on the sub-processors page. If you need a signed data processing agreement, ask us at [email protected].
13. Changes to these terms
We will post the new version here and email account holders before a material change takes effect. Continuing to use the service afterwards means you accept it; if you do not, close the account and these terms end with it.
14. Law and disputes
This agreement is governed by the law of Spain, and its courts have jurisdiction — except that if you are a consumer, you keep the protection of the mandatory law of the country you live in, and you may bring proceedings there.
If a clause turns out to be unenforceable, the rest stands. Our failure to enforce something is not a waiver of it.
